HOW TO MAKE A CLAIM
If anything happens that may lead to a claim being made, you must do your best to minimise its affect, and be careful to gather all the supporting evidence needed under the relevant section of the policy to prove it occurred, and to quantify its value accurately. See GENERAL CONDITIONS FOR CLAIMS.
You should contact the appropriate Service as follows, and in doing so be prepared to provide details from your Certificate of Insurance, and confirm which section of the policy you are claiming under. You will receive instructions on how to deal with your particular circumstances, and on how to lodge your claim.

Charge Care International - If you are in Spain, Greece, Cyprus, Portugal or Turkey and need out-patient medical treatment please provide a copy of your Certificate of Insurance to the doctor and your treatment will be paid by ChargeCare International in line with the policy. You will be asked to fill in a simple form to confirm the treatment. The doctor will send the form to ChargeCare International together with the balance of the medical bill after deduction of the policy excess you have paid to the doctor.

As soon as circumstances arise that might lead to a claim under the following sections of the policy:
(C) PERSONAL ACCIDENT, (E) TRAVEL DELAY (abandon at Trip), (J) PERSONAL LIABILITY,
(K) CATASTROPHE, or (O) CANCELLATION.
OTHERWISE, if you need to make a claim, you must notify the Claims Service at least within 28 days of returning Home. You will be sent a claim form, or you can download the appropriate form from their website. Complete the form and return it promptly with your Certificate of Insurance and the original documentary evidence required in the circumstances.

SCHEDULE OF COVER |
- The policy is divided into sections for the various aspects of cover provided. Each section has a limit on the amount that we pay in the event of a claim. Some sections include other specific limits. Some sections also have an Excess as detailed below, which means that your will have to bear this amount of any claim.
- Sections (L), (M), (N), (0), (P), (Q) and (R) are subject to availability for cover selected, and payment of the appropriate additional premium when applicable.
- For Annual Insurance the Schedule of Cover Limits apply: per Person, per Trip.
- For Long Stay and Short Trip Insurance the Schedule of Cover Limits apply: per Person, per Claim.

MASTER POLICY OPT0075
We have tried to make this Insurance Policy easy to follow, and to write it in plain English so that the meaning is clear throughout. Please read it carefully.
The policy gives full details of the terms and conditions of the insurance and the extent of cover provided by the insurers, Groupama Insurance Company Limited, under Master Policy OPT0075, issued to Etravelinsure Limited by Optimum Underwriting Limited, as underwriting agents of the insurers.
A Certificate of Insurance is issued to you when you take out this insurance, and it is dated on that date. It is documentary evidence that, in return for payment of the required premium, each person named in it is insured for the cover and the period of insurance stated, subject to the terms, conditions and exclusions of the policy. The Certificate of Insurance and any endorsements to it and the policy are a contract of insurance between the insured persons and the insurers. Your normal Statutory Rights are not affected by it.

DEFINITION OF CERTAIN WORDS AND TERMS
You, your, and Insured person(s) applies to one or all persons named on your Certificate of Insurance, who are also referred to as:
Adult(s), means person(s) aged over 16 and under 66 years.
Younger Adult(s), means person(s) aged over 16 and under 40 years.
Child, children means person(s) aged 16 years and under.
Our, we, us and Insurer(s) - means Optimum Underwriting Limited as an underwriting agent for Groupama Insurance Company Limited.
The policy sections give the details of the cover provided. Headings used in these sections have the full meanings as follows, and are highlighted in the policy by being in bold type:
You are covered for: means that, we will pay, indemnify, or reimburse you the amount of the loss that we agree you have suffered (subject to the terms, conditions and exclusions of the section, and after deducting the relevant Excess amount), up to the maximum limit(s) of the section that applies to your Schedule of Cover.
For a claim: means that when submitting a claim you will be required to provide the information stated under General Conditions for Claims of the policy.
Evidence of Loss: means the information that our Claims Service may ask you to provide as stated under Evidence of Loss in General Conditions for Claims of the policy.
Other words and terms are also defined because they always have the same meaning. They are highlighted in the policy by being in bold type, and are as follows:
Abroad is outside the territorial borders of your Home Country.
An Accident is a violent external event, occurring completely by chance at a given place and time, that suddenly and independently causes a person immediate and visible bodily injury and/or material damage to property.
Authorities are any Customs, Police, Fire, Transport, or Military Services; any National or Local Government; or any International Authority such as (but not limited to) the World Health Organisation.
Carrier means the airline, rail, bus, ferry or shipping company providing Transport services.
Disruption to Transport Services means failure of services to run to scheduled times due to adverse weather conditions, mechanical breakdown, accident, strike or industrial action, which were not common knowledge, and which you were unaware of when making your travel arrangements or taking out this insurance.
Home is your permanent place of residence in your Home Country, used for domestic purposes, including garages and outbuildings.
Home Country means that you are resident, with a Home, in the United Kingdom, the Channel Islands or the Isle of Man. The United Kingdom, which is one Country for the purpose of this definition, comprises: England, Wales, Scotland, Northern Ireland.
Immediate Family is your Partner, and: parents, children, stepchildren, fostered or adopted children, brothers, sisters, grandchildren, or grandparents, of either you or your Partner, who live in your Home Country.
International Departure Point means the international airport, seaport, bus or train station at which you embark on Transport for a main stage of the journey to or from your Home Country.
Qualified Medical Practitioner is a registered practising member of the medical profession who is not related to you or any person with whom you are travelling.
Partner is your spouse or someone of either sex with whom you have a permanent relationship, and who also lives with you at your Home.
Transport is a train, bus, coach, ferry, or scheduled airline flight, running as a public service to a published timetable.
Trip means a journey Abroad, to a destination in the Geographical Area and within the Period of Insurance stated on the Certificate of Insurance, which begins when you set out to travel Abroad, and which normally ends on the date you have planned to return Home.
your Schedule of Cover means the parts of the Schedule of Cover of the policy that apply to the level of cover and options of cover that you have chosen for your insurance. These are stated on your Certificate of Insurance.

MATERIAL FACTS DISCLOSURE
You must disclose all Material Facts that could influence us in accepting your insurance, and further inform us of any changes in circumstances that occur up to the time you depart. A Material Fact is a fact or circumstance that means there being a more than normal chance of you suffering a loss whilst insured under the policy. To disclose a Material Fact, you must contact the Customer Services Manager at Etravelinsure Limited to be advised of the procedure to follow in the circumstances.

PRE-EXISTING CONDITIONS
A Pre-existing Condition is if, when this insurance is taken out or at any time before you depart on your Trip, any person travelling or anyone on whose health the start or continuation of the Trip may depend:
(1) is aware of any medical condition or set of circumstances which could reasonably be expected to give rise to a claim;
(2) has received treatment or consultation for any chronic or recurring illness during the last 12 months;
(3) is receiving, recovering from, or on a waiting list for in-patient treatment in a hospital or nursing home;
(4) is suffering from any clinically diagnosed psychiatric disorder, anxiety, depression, or eating disorder;
(5) is awaiting results of medical tests or investigations;
(6) has been diagnosed as having a terminal illness;
(7) is expecting to give birth before or within 14 weeks of the date of your arrival Home;
(8) is travelling against the advice of a Qualified Medical Practitioner;
(9) is travelling to receive medical treatment Abroad.
If the answer is positive to any one of the above conditions, the policy as a whole does not cover any loss directly or indirectly caused by or attributable to that condition; refer to the General Exclusions paragraph 2. Medical (1).
You must inform us immediately should a condition occur after insurance is taken out, and if a claim is not made for Cancellation of the Trip under Section (0) of the policy, we have the right to amend or cancel your cover.

GENERAL CONDITIONS
The policy, as a whole, has the following conditions:
1. Your general obligations, you must:
(1) before taking out this insurance, take reasonable steps to satisfy yourself that the cover provided is what you require
(2) disclose all Material Facts that could influence us in accepting your insurance, and further inform us of any changes in circumstances that occur up to the time you depart
(3) ensure that you will not suffer any uninsured loss due to exclusions of cover for Pre-existing Conditions of persons travelling, or persons on whose health your Trip depends
(4) in taking out the insurance, make sure that all persons to be insured are eligible for cover, and give accurate details of their names and age, your Home address, together with your cover commencement
date and destination area. If you find that any particulars finally stated on the Certificate of Insurance are incorrect, or are not fully to your requirements, or changes occur subsequently (such as your Home
address), you must notify us immediately
(5) ask for the insurance to be cancelled if circumstances arise that make you uninsured, or not eligible,
or if within 14 days of taking out the insurance or before you travel (whichever is earlier) you decide that it is not what you want.
The insurance will then be cancelled as if never issued, and the premium will be refunded in full
(6) take advantage whenever reasonably possible of Reciprocal Health Care Agreements that can provide you with free or reduced-cost medical treatment
(7) take reasonable care to protect yourself from injury and illness, to safeguard your property, and to act responsibly; as though you were uninsured.
2. Legal interpretation, unless otherwise agreed:
The policy is governed by English Law.
3. Extension of Cover:
If your return Home is necessarily delayed for insured reasons, the
Period of Insurance may be extended by us or our Emergency Service for a
reasonable period to allow for your return Home.

GENERAL CONDITIONS FOR CLAIMS
The policy, as a whole, has the following conditions that apply in circumstances that might lead to a claim, and in submitting a claim:
1. You must:
(1) not admit fault, promise compensation or offer payment to anyone, or become involved in litigation without our consent
(2) make a reasonable effort to find and recover lost or stolen items, and protect damaged items from further loss or damage
(3) not dispose of or abandon any item that is subject to a claim.
(4) cooperate fully with our Claims Service, and at your own expense provide promptly such Evidence of Loss, medical history details, and other information specifically required, as is reasonably requested.
Evidence of Loss is any of the following that you may be asked to provide as original documents:
Financial:
(a) an invoice identifying the item or service you purchased.
(b) a receipt showing how and when you paid for the item or service in question.
(c) in the absence of (b) a bank or card-providers statement or confirmation showing payment.
(d) for items within personal possessions classed as valuables, in the absence of (a) to (c), a recent professional valuation dated before the date of the loss.
(e) original travel tickets or counterfoils, travel documents and itinerary schedules.
(f) any document for refund, compensation, repayment, recovery, credit note, or transfer of value.
Reported:
(a) a loss or theft must be reported to the local Police within 24 hours of it being discovered. The resulting Police report is required, bearing a crime/incident reference, confirming the details reported.
(b) if loss, damage or theft occurs whilst you are in a hotel, in accommodation, or using Transport or other services Abroad, or if such loss occurs whilst the service had custody of your belongings; you must report it in writing to the
management of the service, in addition to the local Police, as soon as possible, and at least within 24 hours of it being discovered. A written response/report is required from the management of the service confirming the circumstances you reported.
(c) loss, damage or delay in transit must be reported to the Carrier as soon as possible after you discover it. A written report is required from the Carrier (a Property Irregularity Report of an airline) acknowledging your reported losses.
If yo were unable to obtain this report at the time, evidence is required that within the following 7 days you made a written request to the Carrier to obtain it.
Medical:
Written confirmation from the Qualified Medical Practitioner(s) who treated you detailing the nature of the illness or injury, and:
(a) confirming that treatments and medication prescribed were medically necessary
(b) for Cancellation or Curtailment of your Trip on medical grounds, confirming why you are or were unfit to travel.
Other: any evidence that is more specifically required or deemed necessary by our Claims Service.
(5) submit any claim as soon as possible, and no later than 28 days after your return Home, in writing using the claim form downloaded from the website, or provided by our Claims Service
(6) provide your original Certificate of Insurance when lodging a claim
(7) send immediately any writ, summons, legal document or correspondence in connection with a claim to our Claims Service, and only respond to it on receiving written advice to do so.
2. Our rights, we are entitled to:
(1) refuse payment of any claim and cancel the policy with immediate effect if any fraudulent means is used to benefit from the policy or a dishonest claim is made
(2) at our expense, and at our own discretion, take proceedings in your name to recover compensation or enforce an indemnity for our own benefit
(3) take over your rights in the defence or settlement of a claim
(4) take over your ownership of any unused travel tickets or bookings where a valid claim results in you having other travel arrangements
(5) require you to reimburse us, within 30 days of our request to you, any amount already advanced on your behalf that turns out to be paid in error
(6) pay the amount due up to the limit shown under your Schedule of Cover for any loss to fully discharge us of any further liability in that respect
(7) repatriate you to your Home Country on medical grounds when in the opinion of our Emergency Service you are fit for the journey by the means that has been arranged
(8) at our expense, require you to be examined by a doctor or suitably qualified person whom we shall appoint, and in the event of death to conduct a post-mortem examination
(9) if another insurance covers the same loss, we are entitled to contact insurers of that policy for a contribution.

8. |
| |
GENERAL EXCLUSIONS
The policy, as a whole, does not cover any loss directly or indirectly caused by or attributable to:
1. General
(1) the Policy Excess, which is the first part of any claim which you are liable to pay or bear, up to the amount shown for the section under the heading of Policy Excess in the Schedule of Cover applicable to your insurance, and by which a claim is reduced on payment to you
(2) Material Facts that you fail to disclose
(3) you not being eligible for this insurance
(4) losses due to changes in currency exchange rates
(5) any consequential losses.
2. Medical:
(1) your death, illness or injury, or that of anyone on whose health your Trip depends, that is caused by or is exacerbated by or is traceable or related to a Pre-existing Condition
(2) pregnancy, childbirth, or any related complication of these conditions, where birth is expected before or within 14 weeks of your arrival Home
(3) before departure on your Trip, failure to obtain the recommended vaccinations and inoculations, or failing to take with you an adequate supply of all the medications you will require
(4) you having or transmitting any venereal or sexually infectious disease
(5) any injury, illness, death, loss, expenses or other liability due to Human Immunodeficiency Virus (HIV), and/or HIV related illness and/or any mutant derivatives or variations thereof however caused.
3. Behaviour:
(1) you failing to take reasonable precautions to avoid a loss following public warnings about bad weather, strikes, civil commotion or other dangers
(2) you being under the influence of alcohol, solvents or drugs (including drugs prescribed for drug addiction)
(3) you being financially insolvent, committing an illegal or malicious or criminal act, being put in prison, being deliberately careless or negligent, or failing to minimise a loss through neglect
(4) you committing suicide, inflicting self-injury, or wilfully exposing yourself to risk or exceptional danger (except in an attempt to save human life)
(5) you taking part in operations of the military, police or emergency services
(6) you not following the recommendations of Authorities against travel to particular countries or areas
(7) you going on dangerous expeditions, or going anywhere that is extremely remote or outside the range of normal rescue facilities
(8) you driving a motor vehicle or riding on a motorcycle, quad bike, or any mechanically assisted cycle without an appropriate licence or when not insured under a motor insurance policy
(9) you riding on a motorcycle, quad bike, or any mechanically assisted cycle with an engine capacity in excess of 125cc, and in any event if you fail to wear a crash helmet.
4. Travel:
(1) your disinclination to travel, phobia, anxiety or depression
(2) the residual value of any loss that could be transferred or compensated
(3) expenses paid or payable using promotional credits, vouchers, or air-miles
(4) compensation for unused timeshare or air-miles entitlement
(5) travel by any aircraft except as a passenger in a fully licensed passenger carrying aircraft on a scheduled flight or chartered by a tour operator
(6) liabilities occurring from the use of motor vehicles
(7) costs that you would normally have incurred even if a claim had not arisen
(8) the financial failure or the seeking of judicial protection from creditors of any Transport operator or travel services provider
(9) air travel within 24 hours of scuba diving.
5. Personal Property:
(1) losses for which you are unable to provide the required Financial Evidence of Loss, other than the cover provided to the limits shown in your Schedule of Cover under the heading: PROPERTY LIMITS FOR ALL SECTIONS
(2) the value of property above that which takes into account depreciation due to age, and wear and tear
(3) the part(s) of a pair or set of items which have not been lost, stolen, damaged or destroyed
(4) loss or theft of property that is left unattended, which is when it is not within your immediate reach or can be taken without your knowledge; unless it was locked in a fixed safety deposit box, or was securely locked inside your residential accommodation, and there is evidence of a forced break-in
(5) loss or theft of property from an unoccupied vehicle; unless it was securely locked out of sight in a compartment or boot, and there is evidence of a forced break-in
(6) any loss from an unoccupied vehicle at any time between the hours of 9.00pm and 9.00am
(7) items within luggage damaged by the contents of broken liquid containers or perishable goods
(8) any property more specifically insured or recoverable under any other source.
6. Events:
(1) actions or orders of Authorities that result in:
(a) restricting your movements
(b) seizure of your property
(c) preventing you having access to your personal belongings, or
(d) the suspension of or disruption to Transport services.
(2) any loss when your Trip is deliberately continued beyond:
(a) the original period of insurance expiry date
(b) the expiry date extended by endorsement
(c) the maximum permitted for any one Trip, or
(d) the final date set and agreed by our Emergency Service.
(3) acts of war and terrorism
(a) war; invasion; acts of foreign enemies; hostilities or warlike operations (whether war be declared or not); civil war; rebellion; revolution; insurrection; civil commotion or uprising; blockade; military or usurped power;
(b) the discharge, explosion, or use of a weapon of mass destruction whether or not employing nuclear fission, or chemical, biological, radioactive or similar agents, by any party at any time for any reason;
(c) any act of terrorism; an act of terrorism means an act, including but not limited to the actual or threatened use of force or violence undertaken by any person(s) or group(s), whether acting alone or on behalf of or in connection with any organisation(s) or government(s), committed for political, religious, ideological or similar purpose including the intention to influence any government and/or to put the public, or any section of the public at fear;
(d) any loss, damage, cost or expense of any nature that results from or is in connection with anything mentioned in clauses (a), (b) and/or (c) above regardless of any other cause or event or sequence of events or any action taken in controlling preventing or suppressing anything mentioned in the said clauses;
You are responsible for proving why this Exclusion, in whole or in part, should not be applied. If any portion of this Exclusion is found to be invalid or unenforcable, the remainder of it will remain in force and effect.
(4) failure of any computer hardware or software or other electrical equipment to recognise or process any date as the true calendar date (this exclusion does not apply to claims made under Section (A) Medical Emergency & Repatriation, Section (B) Medical Benefit, and Section (C) Personal Accident)
(5) any loss or damage to any property and expense or legal liability arising from (a) ionising radiations or contamination by radioactivity from any nuclear fuel or nuclear waste from the combustion of nuclear fuel; (b) the radioactive, toxic, explosive or other dangerous properties of any explosive nuclear assembly or nuclear component thereof; (c) pressure waves from aircraft and other flying objects travelling faster than the speed of sound
(6) escape of harmful biological particles, chemical substances, or pollutant
(7) the death or illness of any pet or animal
(8) loss of enjoyment, or experiencing less than expected enjoyment, in any aspect of your Trip.

PERSONS ELIGIBLE
You must have cover for the whole duration of any Trip on departure from your Home Country, and all those named on a Certificate of Insurance must reside in that same country.
ADULTS: are within two bands: younger adults and adults. Only younger adults are eligible for Long Stay insurance. Age bands apply to the age of a person at the cover commencement date. For Annual Insurance this date is the start date of the annual policy. For Single Trip and Long Stay Insurances this date is the start date of the Trip. Adults insured on the same Certificate of Insurance may travel independently.
CHILDREN: are aged 16 years and under at the cover commencement date. Up to 6 children may be included. Children can only be insured to travel with adult(s) on the same policy or who also insure with us for the same trip. Children do not necessarily have to be the offspring of the adult(s) insured.
For Annual Insurance: children must be dependents of an adult insured, and must travel with or set out to be with at least one adult insured.
For Short Trip Insurance: at least one child must be a dependent of an adult insured on the same policy. Other children need not necessarily be the dependents of the adult(s) insured.

PERIOD OF INSURANCE
(WHEN COVER STARTS AND ENDS)
For Cancellation, under Section (0) of the policy, cover starts when whichever of the following occurs last:
For Short Trip and Long Stay Insurance: when the Certificate of Insurance is issued on taking out insurance, or when the Trip is booked;
For Annual Insurance: at 00.01 hours on the commencement date as started on the Certificate of Insurance, or when a Trip is booked within the annual period;
Cover ends for Cancellation when cover is deemed to start for a Trip , or the expiry of the Annual Insurance (whichever is earlier).
For a Trip , insurance must be taken out before you leave your Home Country, and cover starts when whichever of the following occurs last (the time is Local Standard Time):
(a) 00.01 hours on the commencement (from) date as stated on your Certificate of Insurance, or the time when the Certificate of Insurance is issued (if later on that day);
(b) you leave your Home to set out on the Trip ;
(c) you leave your place of business to set out on the Trip ;
Cover ends when whichever of the following occurs first
:
(a) midnight on the expiry (to) date as stated on your Certificate of Insurance;
(b) you return to your Home Country before the planned end of the Trip , having abandoned the Trip ;
(c) you return to your place of business at the planned end of the Trip ;
(d) you return to your Home at the planned end of the Trip ;
(e) 24 hours after you return to your Home Country at the planned end of the Trip ; and
(f) for Annual Insurance: cover ends at midnight on the day of the maximum days allowed for a Trip .

EXTENDING THE PERIOD OF INSURANCE
Short Trip and Long Stay: If you want to extend cover you must apply in writing (letter, fax or email) well before the period expiry. An extension of cover will be granted at our discretion, and on payment of the appropriate additional premium, an Endorsement will be issued stating the new expiry date.
Annual Insurance: you may extend the planned end of your Trip without applying to us, but the duration of the whole Trip must not exceed the maximum permitted, nor extend past the annual expiry date without the policy being renewed for the following year.

LONG STAY INSURANCE
OUT OF AREA STOP OVER: On a Long Stay Trip to Areas 2 or 3 you are allowed a number of days (calculated on the number of months duration of the whole Trip) to stop over in another area. A stop over can be taken on either the outward or inward legs of the Trip, or split between both.The number of days allowed is stated on your Certificate of Insurance.
TEMPORARY RETURNS HOME: On temporary return Home during a Long Stay Trip, cover under the policy is suspended whilst you are in your Home Country, and for further travel Abroad there will be no cover under Sections (E), (F), (G) and (0).

RECIPROCAL HEALTH CARE
If you require emergency medical treatment for reasons covered under the policy, you will be expected to take advantage (whenever it is reasonably possible) of existing Reciprocal Health Care Agreements. These can provide certain treatments under the State Health Care of various countries, at reduced cost, or even free in some cases. For example, there is such an agreement between EU member countries using the European Health Insurance Card (EHIC). Other non-EU countries are also party to this agreement. UK and the Republic of Ireland also have similar arrangements with Australia, New Zealand, and several other countries.
The EHIC is essential for European travel, and is issued with a useful booklet containing advice on health precautions to take whilst abroad. It also gives details of all the countries where Reciprocal Health Care provisions apply, beside those to which the EHIC applies, and explains the types of treatment that are covered, and how to go about obtaining your entitlement, which differs from country to country.

SECTION (A) MEDICAL EMERGENCY & REPATRIATION
If you require emergency medical treatment whilst on a Trip as a result of: an injury sustained in an Accident, or
an illness which first shows itself during a Trip,
You are covered for: reasonable and necessary costs that our Emergency Service agree to in advance for:
(1) transport to a suitable hospital, hospital accommodation, medical, surgical or other treatment, given or prescribed by a Qualified Medical Practitioner
(2) in the event of death, conveying the body or ashes to your Home Country
(3) repatriation on medical grounds by whatever means is agreed by our Emergency Service, and, for Short Trip and Annual Insurance, the return Home if necessary of all insured persons
And, up to specific limits on certain costs, shown in your Schedule of Cover for:
(4) unauthorised Costs - costs for treatment prescribed by a Qualified Medical Practitioner, which have not been authorised by our Emergency Service in advance
(5) emergency dental - costs for emergency dental treatment
(6) burial Abroad - costs of burial or cremation in the country where death occurs
(7) additional support - costs of economy class travelling and room accommodation for one relative or friend who is a resident of your Home Country, and who, on medical advice, must stay with you and/or
accompany you Home.
For a claim: in an emergency contact our Emergency Service immediately, and you must provide the required Evidence of Loss (not already available to our Emergency Service). General Exclusions apply, in particular those headed Medical and
Behaviour,
and specific exclusions are:
(1) any treatment not confirmed by a Qualified Medical Practitioner as being medically necessary for the relief of pain and suffering,
or which could reasonably be postponed until after your return Home
(2) any amount recoverable under a Reciprocal Health Care Agreement with another country
(3) medication and / or treatment which is known to be required or continued whilst you are Abroad
(4) costs that arise after you have refused the offer of repatriation when in the opinion of our Emergency Service you are fit to travel by the means arranged
(5) additional costs of a private or single room at hospital unless approved by our Emergency Service
(6) costs that arise over 6 months after a claim was first notified
(7) costs incurred in your Home Country other than in transporting you or your remains Home from Abroad.

SECTION (B) HOSPITAL BENEFIT
Following a valid claim under Section (A) as a result of which you are confined as an in-patient in a hospital Abroad as agreed by our Emergency Service,
You are covered for: the benefit of a daily sum for every complete 24 hours of your stay in hospital.

17. |
| |
SECTION (C) PERSONAL ACCIDENT
If, within 180 days of it occurring, an Accident is the sole and direct cause of either your death or disablement caused by one of the following bodily injuries:
(1) loss by severance or total and permanent loss of use of one or both hands at or above the wrist, or one or both feet at or above the ankle,
(2) total and irrecoverable loss of all sight from one or both eyes,
(3) permanent total disablement: a disablement that has lasted for at least 12 months from which in our opinion you will never recover, and which entirely prevents you from attending to any employment or
occupation.
You are covered for: an amount in compensation, as shown on your Schedule of Cover, for death or disablement from one of the above causes.
For a claim: contact our Claims Service immediately, and you must provide a fully detailed Medical Report from the Qualified Medical Practitioner(s) involved in the case, and the Death Certificate in the event of death. General Exclusions apply, in
particular those headed Medical and Behaviour, and specific exclusions are: death or disability due to: a disease or any physical defect, injury or illness which existed before your Trip, or due to pregnancy.

SECTION (D) CURTAILMENT
If unforeseen and unavoidable circumstances make it necessary for you to return Home before the planned end of your Trip due to:
(1) you or your Immediate Family suffering death, severe injury, or sudden and serious illness
or, where you are:
(2) required to appear in Court as a witness, except in a professional capacity
(3) required by the Police or Fire Services to return Home immediately due to burglary or suspected burglary at your Home, or due to your Home being made uninhabitable by fire, explosion, storm or flood
You are covered for: your proportion of irrecoverable deposits and payments for unused travel and accommodation contracted for or paid for in advance taken from the date that you begin your journey Home, and reasonable additional costs,
as reed by our Emergency Service, for your return Home.
For a claim: contact our Emergency Service immediately, and you must provide the required Evidence of Loss, and documentary evidence confirming it necessary to curtail the Trip. General Exclusions apply in particular those headed Medical, Travel and Event
, and specific exclusions are:
(1) failure of any service providers such as (but not limited to) travel agents, tour operators, hotels or accommodation agencies
(2) consequences of Authorities warning that it is unsafe to visit or remain in regions or countries
(3) changes being made to your holiday entitlement
(4) resuming the Trip after returning to your Home Country
(5) any additional costs arising from your failure to inform all parties involved immediately you knew that you should cut short your Trip.

19. |
| |
SECTION (E) TRAVEL DELAY
If Disruption to Transport Services causes a delay in the scheduled departure of your pre-booked Transport at the International Departure Point, of at least:
(1) 12 hours, on the first leg of your outward or return journey, or,
(2) 24 hours, on the first leg of your outward journey, causing you to abandon your Trip due to the delay.
You are covered for: the benefit amount (a) for the first full 12 hours delay beyond the intended departure time, and for each subsequent full 12 hours delay, up to the total limit, or, if you abandon your Trip, up to amount (b) for your proportion of irrecoverable deposits and payments for unused travel and accommodation contracted for or paid for in advance.
For a claim: you must provide written evidence from the Carrier confirming the length and nature of the delay, and if the claim is for abandonment of your Trip you must also provide the required Financial Evidence of Loss. General Exclusions apply, in particular those headed Events, and specific exclusions are:
(1) if you do not check-in before the intended departure time of the Transport service
(2) Transport not booked more than 48 hours before its planned departure time
(3) additional costs where Carriers or tour operators offer reasonable alternative travel arrangements.

SECTION (F) BAGGAGE DELAY
If your baggage, containing your personal possessions (as defined under section (M) of the policy), is delayed, misdirected, misplaced or lost in transit by the Carrier on your outward journey for at least 12 hours from the time of your arrival at your destination Abroad
You are covered for: the cost of replacing essential items of clothing and toilet requisites up to the amount shown on your Schedule of Cover.
For a claim: you must provide the required Financial and Reported Evidence of Loss. General Exclusions apply, in particular those headed Travel and Events.
Costs incurred in replacing items will be deducted from any claim under section (M) if the items that were replaced are included in a claim for the permanent loss of personal possessions.

SECTION (G) MISSED DEPARTURE
If you reach the International Departure Point on your outward journey, or final return journey, too late to commence your travel arrangements as planned due to:
(1) Disruption to Transport Services, or
(2) the motor vehicle you used breaking down or being directly involved in a traffic accident
You are covered for: additional costs of travel and accommodation necessarily incurred to reach your planned destination or to return Home by the most direct route up to the amount shown on your Schedule of Cover.
For a claim: you must provide the required Financial Evidence of Loss, and depending on the cause of the delay:
(1) written evidence from the Transport operator on the length and cause of the disruption
(2) written evidence that the vehicle used was roadworthy and properly maintained, and confirmation of the circumstances of the delay from the garage or Authority attending the breakdown or accident.
General Exclusions apply in particular those headed Travel and Events, and specific exclusions are:
(1) your failure to allow plenty of time for the journey to the International Departure Point to check-in for departure as the Carrier or service provider’s itinerary schedule recommended
(2) delays resulting from your journey to the International Departure Point involving connecting sea travel
(3) a vehicle failure due to it not having been properly serviced and maintained
(4) additional costs where reasonable alternative travel arrangements and accommodation are available from the Carriers or offered by tour operators
(5) claims for additional mechanical wear and tear or depreciation of your vehicle or mileage charges other than additional fuel and oil.

SECTION (H) HIJACK
If you are held hostage due to the hijack or the unlawful seizure of the Transport in which you are a passenger during the period of your Trip,
You are covered for: the daily benefit for every completed 24 hours that you are held by the hijackers.
For a claim: you must provide a written Police report confirming the length and exact nature of the hijacking. General Exclusions apply in particular those headed Events.

SECTION (I) LEGAL EXPENSES
This section of cover is arranged and managed by Lexceteras Limited.
If you are injured or you die during the period of your Trip,
You are covered for: your legal costs and expenses incurred to claim for compensation or damages, up to the maximum stated in your Schedule of Cover,
Provided that: Lexceteras Limited shall have control over the legal proceedings and the selection, appointment and control of a solicitor.
For a claim: contact Lexceteras Limited. All General Exclusions apply, and specific exclusions are:
(1) costs or expenses that Lexceteras Limited has not agreed to
(2) any claim not reported to Lexceteras Limited within 180 days after the event giving rise the claim
(3) any claim against a travel agent, tour operator or Carrier, Lexceteras Limited, Etravelinsure Limited, Optimum Underwriting Limited or Groupama Insurance Company Limited
(4) actions between members of the same family or household, or actions to enforce a judgement or legally binding decision
(5) any claim where Lexceteras Limited considers that your prospects of success in achieving a reasonable benefit are insufficient or where the cost of the action could be more than the settlement.

SECTION (J) PERSONAL LIABILITY
If a legal claim is made against you (in a personal capacity) for causing bodily injury, disease or death to any person, or loss or damage to material property due to an Accident that occurred during the period of your Trip
You are covered for: reasonable legal costs for defending claims, and the amount that you become legally liable to pay as damages or compensation, up to the amount shown on your Schedule of Cover.
For a claim: inform our Claims Service immediately. We shall take complete charge in the conduct of all negotiations and proceedings. General Exclusions apply, in particular those headed Behaviour, Travel and Events and specific exclusions are:
(1) causing loss, injury, disease or death to insured persons, travelling companions, or to your or their relatives, employees or household members
(2) causing loss or damage to property owned by, in trust to, or the responsibility of insured persons, travelling companions, or their relatives, employees or household members
(3) anything arising out of: (a) racing of any kind; (b) care, custody or control of animals (c) the ownership,
custody, or use of: firearms or explosives, aircraft, aerial devices, motorised watercraft, horse-drawn vehicles, mechanically-propelled/motorised or towed vehicles;
this exclusion does not apply to activities covered under Section (S) ACTIVITIES except where cover under this section is excluded for specific activities
(4) anything arising out of paid or voluntary work, conducting a trade, business or profession
(5) any liability arising through a contractual agreement, but for which no liability would arise
(6) any liability covered under any other insurance policy
(7) any form of ownership or occupancy of land or buildings, except occupation only of temporary holiday accommodation
(8) punitive or exemplary damages or compensation
(9) any deliberate act or omission.

SECTION (K) CATASTROPHE
If the Authorities of the region or country where you are staying give directives that force you to quit or not to be able to occupy your pre-booked and pre-paid accommodation due to fire, explosion, earthquake, storm, flood, or medical epidemic
You are covered for: the necessary additional costs of providing similar alternative accommodation, up to the amount shown on your Schedule of Cover.
For a claim: inform our Claims Service immediately, and you must provide the required Financial Evidence of Loss and evidence of the directives from Authorities confirming the timing and occurrence of events that forced you to move. General Exclusions apply in particular those headed Travel and Events and specific exclusions are:
(1) you leaving your pre-booked accommodation voluntarily in the absence of or contrary to the advice of the Authorities
(2) losses that are wholly or partly recoverable from or compensated by Authorities, hotels, Carriers, or other service providers.

SECTION (L) LOSS OF PASSPORT/DRIVING LICENCE
If you pay for cover under this section, and if your passport or driving licence is lost or stolen whilst you are Abroad when it is: carried on the person of an adult insured, or is locked in a fixed safety deposit box,
You are covered for: your reasonable and necessary additional travel and accommodation expenses directly related to obtaining a temporary or permanent replacement, up to the amount shown on your Schedule of Cover.
For a claim: you must provide the required Financial and Reported Evidence of Loss, and for passports and visas a letter from the consulate where you obtained the replacement documents, and for a driving licence evidence of you being supplied with a replacement. General Exclusions apply, in particular those headed Events.

SECTION (M) PERSONAL POSSESSIONS
If you pay for cover under this section, and if your personal possessions, comprising your suitcases or luggage, their contents of items taken for personal use, and items worn or carried by you, that you own (not hired, loaned or entrusted to you), includ
ng valuables, are stolen or permanently lost or damaged by accident during your Trip,
You are covered for: the cost of repairing damaged items (if less than their value) or the value of items after making proper allowance for their depreciation. Within the overall limit for each person, as shown on your Schedule of Cover, the following specific limits apply:
(a) for any one single item, pair or set (a pair or set being items normally used or worn together)
(b) for all valuables in total
(c) for all sports equipment in total, if the equipment was not being used at the time of loss Or, if you are unable to provide the required Financial Evidence of Loss, further limits apply, which are in your Schedule of Cover under the heading Personal Property without Financial Evidence of Loss.
Valuables are the following items: Watches, furs, leather goods, animal skins, silks, jewellery, items made of or containing precious stones, semi precious stones, gold, silver or platinum, photographic, audio, video and electrical equipment of any kind, camcorders and accessories, all photographic/digital/optical/audio and video media, telescopes and binoculars.
For a claim: you must provide the required Financial and Reported Evidence of Loss. General Exclusions apply in particular those headed Personal Property and Events, and specific exclusions from cover are:
(1) any of the following: any of the following: perishable goods; dentures; hearing aids; contact or corneal lenses; sunglasses; spectacles; certificates and documents of any kind; antiques; glass; china; fragile items; pictures; works of art; musical instruments; sports equipment whilst being used; vehicle parts; marine equipment; pedal cycles; household goods; tents; alcohol; cigarettes and any tobacco products; computers and all computer equipment; game consoles (including hand held consoles) and their accessories; mobile phones and their accessories; satellite navigation systems (GPS) and/or accessories; Personal Digital Assistants (PDA’s) and/or accessories; televisions; business merchandise or samples; tools of trade
(2)loss or theft of Valuables:
(a) left as check-in luggage with Carriers;
(b) worn or carried by Children;
(b) left in an unoccupied motor vehicle;
(3) loss of jewellery (other than wedding rings) while swimming, or partaking in any hazardous pursuits.

SECTION (N) MONEY
If you pay for cover under this section, and if current travellers cheques, travel tickets, banknotes and coins are lost or stolen whilst you are Abroad, when carried on the person of an adult insured or locked in a fixed safety deposit box,
You are covered for: your loss up to the amount shown on your Schedule of Cover, and for cash up to the limit for (a) Cash.
For a claim: you must provide the required Financial and Reported Evidence of Loss, and evidence that you reported the loss of travellers cheques to the issuing Bank or agent as soon as possible following the discovery of the loss. General Exclusions apply in particular those headed Events, and a specific exclusions is: for losses due to
depreciation in value or shortage due to error or omission.

SECTION (O) CANCELLATION
If you pay for cover under this section, and if unavoidable, unforeseen, circumstances occur outside your control during the cancellation Period of Insurance prior to departure that make it necessary for you to cancel or defer a pre-booked Trip due to:
(1) you or your Immediate Family suffering death, severe injury, or sudden and serious illness
(2) an epidemic or compulsory quarantine preventing travel
or, where you are:
(3) called upon for Jury service that you are unable to have deferred
(4) required to appear in Court as a witness, except in a professional capacity
(5) required for duty in the Armed Forces, or Emergency Services
(6) required by the Police or Fire Services not to go away, within 14 days before the planned start of your Trip, due to burglary or suspected burglary at your Home, or due to your Home being made uninhabitable
by fire, explosion, storm or flood.
You are covered for: your proportion of irrecoverable deposits and payments for travel and accommodation contracted for or paid for in advance up to the amount shown on your Schedule of Cover
For a claim: contact our Claims Service immediately, and you must provide the required Financial and Medical Evidence of Loss, and documentary evidence confirming it necessary to cancel your Trip. General Exclusions apply, and specific exclusions a

(1) failure of any service providers such as (but not limited to) travel agents, tour operators, hotels or accommodation agencies
(2) any consequences of Authorities advising against travel to a country or area
(3) loss of employment for any reason
(3) changes being made to your holiday entitlement except for members of the Armed Forces and Emergency Services
(4) any additional costs arising from failing to inform all parties involved immediately you knew that your Trip had to be cancelled.

SECTION (P) WINTER SPORTS
If you pay for cover under this section, and if in the course of a Trip to a pre-booked winter sports destination you suffer a loss due to any of following:
You are covered, up to the amount shown on your Schedule of Cover, for:
(1) Ski Equipment: if your own Ski Equipment is permanently lost or damaged by accident:- the cost of repairing damaged items (if less than their value) or the value of items after making proper allowance for their wear and tear or depreciation.
(2) Ski Equipment Hire: if your own Ski Equipment is lost or damaged by accident, or is delayed in transit for more than 12 hours after your arrival at your destination:- the hire of equivalent Ski Equipment fo
each day that your own equipment is not available or usable.
(3) Ski Pack: if you are unable to use the Ski Pack facilities which were contracted for or paid for in advance prior to your departure due to you suffering an injury or illness that prevents you skiing, or if your
ki pass is lost or stolen :- costs of the non-refundable proportion of unused facilities.
(4) Piste Closure: if lack of snow conditions or adverse weather results in the total closure of skiing at your resort and it is not possible to ski anywhere at your resort during a day :- the daily benefit in compe
sation for each day you are unable to ski.
Definitions: Winter Sports are the activities listed under the heading of Normal Winter Sports in the Schedule of Activities, with the specific conditions that apply to certain activities, covered under
Section (S) of the policy.
Ski Equipment shall mean skis, ski boards, ski poles and ski boots.
Ski Pack shall mean hired Ski Equipment, lift passes, and ski tuition fees.
For a claim: you must provide the required Evidence of Loss, and:
(1) For unused Ski Pack facilities, if the claim is not being handled by our Emergency Service, a certificate from a local Qualified Medical Practitioner confirming that the injury or illness suffer preven
ed you from skiing for the period that your facilities were unused, and proof that refundable parts of the facilities were applied for
(2) For Piste Closure, evidence from your resort that all ski lifts and facilities were closed, and evidence that at the time of taking out this insurance or of booking your Trip the probable closure of the resor
was not public knowledge nor known to you.
General Exclusions apply, in particular those headed Medical, Personal Property and Events. The limits in your Schedule of Cover under the heading Personal Property without Financial Evidence of Loss apply. And, a specific exclusion is participating in activities other than those listed under the heading of Normal Winter Sports in the Schedule of Activities.

SECTION (Q) GOLF COVER
If you pay for cover under this section, and if in the course of a Trip you suffer a loss due to any of following:
You are covered, up to the amount shown on your Schedule of Cover, for:
(1) Golf Equipment:
if your own Golf Equipment is permanently lost or damaged by accident, the cost of repairing damaged items (if less than their value) or the value of items after making proper allowance for their wear and tear or depreciation
(2) Hire of Golf Equipment: if your Golf Equipment is lost or damaged by accident, or is delayed in transit for more than 24 hours after your arrival at your destination :- the hire of replacement equipment for
each day that your own equipment is not available nor usable
(3) Green Fees: if you suffer an illness or injury (subject to specific exclusions under Section (A) of the policy) which a certificate from a local Qualified Medical Practitioner confirms will totally prevent you from
playing golf :- the cost of the non-refundable proportion of unused green fees which were contracted for or paid for in advance.
Golf Equipment means your own golf clubs, golf bag, non-motorised trolley, balls, tees, shoes, and umbrellas.
For a claim: you must provide the required Evidence of Loss. General Exclusions apply, in particular those headed Medical, Personal Property and Events.
The limits in your Schedule of Cover under the heading Personal Property without Financial Evidence of Loss apply.

SECTION (R) BUSINESS COVER
If you pay for cover under this section, and if in the course of a Trip you suffer a loss due to any of following:
You are covered, up to the amount shown on your Schedule of Cover, for:
(1) Business Equipment: if your own Business Equipment is permanently lost or damaged by accident, the cost of repairing damaged items (if less than their value) or the value of items after making proper allowance for their wear and tear or depreciation
(2) Resumption of your Trip: if your Trip is disrupted due to Curtailment or Medical Problems, the resumption of your Trip :- the costs (using economy class travel and other essential expenses) of
transporting you to the point at which your original journey was curtailed, provided that the resumed journey begins within 4 months of the curtailment of the original Trip, OR
(3) Replacement Personnel: if your Trip is disrupted due to Curtailment or Medical Problems :- the cost of transporting a substitute employee (using economy class travel and other related expenses) to take
your place.
Business Equipment means any item which is the property of you or your employer and for which you are responsible which is taken on or acquired during your Trip, and which is essential to your business. Curtailment or Medical Problems means a valid claim under Section (D) of the policy for the curtailment of your Trip, or you suffering an illness or injury (subject to specific exclusions under Section (A) of the policy)
which a certificate from a local Qualified Medical Practitioner confirms will totally prevent you from attending to your business for a period in excess of 7 days.
For a claim: you must provide the required Evidence of Loss. General Exclusions apply, in particular those headed Medical, Personal Property and Events.
The limits in your Schedule of Cover under the heading Personal Property without Financial Evidence of Loss apply.
Specific exclusions from cover are:
defects in equipment; software malfunction or corruption; perishable goods; certificates or documents; antiques; glass; china; pictures; works of art; musical instruments; sports equipment whilst being used; vehicle parts; satellite navigation systems (GPS) and/or accessories; marine equipment; pedal cycles; household goods; alcohol; tobacco products.

SECTION (S) ACTIVITIES
You are covered for: ‘safe and normal’ participation in the sports and activities described in the Schedule of Activities, as an amateur to amateur competition level. ‘Safe and normal’ participation means firstly that:
(a) you are reasonably fit and competent to take part;
(b) you take notice of local warnings of danger or adverse weather conditions;
(c) you participate in safe areas and/or areas covered by rescue facilities;
(d) you have the necessary qualification or licence if such is needed to participate; and
(e) you wear all the normal protective clothing and head gear and observe the normal safely procedures of the sport or activity.
Besides which, ‘safe and normal’ participation in certain activities is based on specific conditions that you are:
(1) accompanied by an experienced and/or suitably qualified instructor or guide;
(2) properly supervised, taking part in an organised event, match, game, session or outing;
(3) using a venue or purpose-built facilities approved by the activity’s local or national regulatory
authorities.
For certain activities the condition is that cover under other sections of the policy is excluded:
(4) cover under Section (C) PERSONAL ACCIDENT;
(5) cover under Section (J) PERSONAL LIABILITY.
The specific condition numbers are annotated to the categories or the individual activities to which they apply in the Schedule of Activities. The General Exclusions of the policy also apply, in particular those headed Behaviour.
In any event, you are expected to wear an appropriate hard helmet when exposed to projectiles, riding vehicles or animals, travelling at speed, or for aerial activities, and to wear a personal floatation device for surface water sports. Besides which, cover for safe and normal participation is provided on certain basic conditions for individual activities as shown in the Schedule of Activities.
Cover is provided under Section (A) MEDICAL EMERGENCY & REPATRIATION of the policy for all categories. Due to the greater degree of risk, the Standard Medical Excess limit that applies to claims under Section (A) is increased to the amounts shown in the Schedule of Cover under Medical Excess Limits for the MEDIUM RISK and HIGH RISK categories.

The categories are:
(1) HOLIDAY ACTIVITIES: The Standard Medical Excess applies.
(2) WORK: The Standard Medical Excess applies. Exclusions to the type of work covered are shown in the Schedule of Activities.
(3) NORMAL WINTER SPORTS: If you have cover under Section (P) WINTER SPORTS the Standard Medical Excess applies, otherwise the High Risk Medical Excess applies.
(4) MEDIUM RISK ACTIVITIES: The Medium Risk Medical Excess applies.
(5) HIGH RISK ACTIVITIES: The High Risk Medical Excess applies.
(6) REFERRAL ACTIVITIES: Hazardous sports and activities which are not included in our Schedule of Activities, and which are therefore not covered, but which may be covered following your referral to us, with endorsement to the Certificate of Insurance for the terms agreed.
We reserve the right to add, remove, or re-categorise activities notwithstanding that cover is provided on the basis of the activities listed under each category heading in the Schedule of Activities at the date of taking out insurance.

BASIC CONDITIONS FOR SAFE AND NORMAL PARTICIPATION IN ACTIVITIES |

(1) You are accompanied by, or accessible to, an experienced and/or suitably qualified instructor or guide.
(2) You are properly supervised, taking part in an organised event, match, game, session or outing.
(3) You are using natural or purpose-built facilities approved for use for the activity by a local or national regulatory authority.

For certain activities the condition is that cover under other sections of the policy is excluded:
(4) cover under policy section (C) PERSONAL ACCIDENT.
(5) cover under policy section (J) PERSONAL LIABILITY.
